PET SITTING SERVICE AGREEMENT

Peppy's Pet Shoppe LLC DBA as Peppy’s Pet Care

1. Overview. 

Client (hereinafter referred to as “Client”), as identified below, enters into this agreement with Peppy’s Pet Shoppe LLC DBA Peppy’s Pet Care, its agents, affiliates, contractors, representatives, assistants, and/or associates, (hereinafter referred to as “Peppy’s”). The terms of this agreement apply to the initial service period during which services will be rendered (hereinafter referred to as the “Service Period”) and any subsequent Service Periods thereafter. The details of services to be provided are expressed separately, either in writing, orally, or both, and may be changed from time to time upon Client’s notification and Peppy’s acknowledgment and agreement. The cost of services is based on Peppy’s published rates and fees, which are available for Client’s review and are subject to change without notice.

2. Confirmation of Service Periods.

Regardless of whether the Client has reserved Service Periods in advance, it is the Client’s responsibility to receive an email confirmation from Peppy’s, indicating the service booking is approved. Without this confirmation, the booking is not valid.

3. Client’s Return.

Peppy’s assumes that Client will return home according to schedule.

4. Extension of Service Period. 

In the event of a delay in the Client’s return, Client must contact Peppy’s at the earliest opportunity. Service Periods may be extended by mutual agreement, preferably by email. If international travel, cruise travel, or emergency situations prevent communication, Peppy’s may extend the Service Period up to 72 hours for the care of the pets, plants, or home. If no contact is made within this time, Peppy’s reserves the right to surrender keys and care of the home and pets to the pre-specified emergency contact, at which point the Service Period will close.

5. Food and Supplies.  

Client agrees to provide adequate food and supplies in good condition for the entire Service Period and in a location that Peppy’s can easily access. Should supplies run out, Peppy’s may purchase reasonable replacements at the Client’s expense, plus an applicable errand surcharge.

6. Security Systems.

Peppy’s is not liable for any charges, fines, or damages resulting from the malfunction or unintended triggering of a security system.

7. Keys and Lockouts.  

Client must provide two working keys to Peppy’s by the end of the second booking. If entry is through a garage code, the Client assumes responsibility for power failures or malfunctions. Should Peppy’s need to pick up or drop off keys, a $35 fee will apply. If a locksmith is required due to malfunctioning locks or incorrect keys provided by the Client, the Client is responsible for all associated costs. Peppy’s is authorized to employ a locksmith on the Client’s behalf if necessary.

8. Property Damage.  

Peppy’s is not responsible for damage caused to the Client’s property by the Client’s pets during the Service Period. If any third party enters the home during the Service Period, Peppy’s is not responsible for any resulting damages.

9. Personal Injury. 

Client assumes responsibility for any injuries or disabilities sustained by Peppy’s caused by the Client’s pets or home (including bites, scratches, mauls, etc.). If Client misrepresents a pet’s aggression history, Client may be liable for punitive damages. Any change in the pet’s behavior must be reported immediately to Peppy’s, and Peppy’s decision to continue care following such a report does not indemnify the Client from liability.

10. Plant Care. 

Upon request, Peppy’s will provide reasonable plant maintenance, but Client agrees to indemnify Peppy’s from any liability if plants are damaged.

11. Outdoor Animals.  

Peppy’s is not responsible for injury, disappearance, or death of pets with unsupervised access to the outdoors, including pets using dog doors.

12. Loss of Animals.  

Peppy’s strongly encourages the Client to maintain accurate identification on their pets. If a pet escapes due to the Client’s failure to follow reasonable precautions, the Client agrees to indemnify Peppy’s for any resulting loss.

13. Urgent Animal Care.  

In case of illness or injury, Peppy’s will make reasonable efforts to secure veterinary care. The Client authorizes Peppy’s to authorize emergency medical treatment up to a designated financial limit. If no limit is provided, Peppy’s will act at its discretion, and the Client agrees to cover all related costs.

14. Urgent Home Care.  

If the Client’s home is damaged during the Service Period, Peppy’s will first attempt to contact the Client or emergency contacts to establish a plan of action. If no contact is made, Peppy’s is authorized to take appropriate steps to secure the home at the Client’s expense.

15. Trespassers. 

During the Service Period, no one other than Peppy’s is permitted on the property without prior approval from both Peppy’s and the Client. If trespassers are present, Peppy’s is not responsible for any resulting situation.

16. Discretionary License.  

Peppy’s reserves the right to suspend services or secure pets in any manner deemed necessary, including crating, tethering, boarding, or sheltering at the Client’s expense, if Peppy’s deems the situation unsafe.

17. Online Registration and Profile. 

Peppy’s uses an encrypted online system, Time To Pet, to store Client information. It is the Client’s responsibility to ensure the information is up to date.

18. Mandatory Arbitration. 

Any disputes between Peppy’s and the Client will first attempt to be resolved through mediation or non-binding arbitration, following the rules of the American Arbitration Association.

19. Attorneys’ Fees. 

If Peppy’s prevails in legal proceedings to enforce this agreement, Peppy’s is entitled to recover reasonable attorneys’ fees and costs from the Client.

20. Payment Terms. 

Payment for the first service is due during the consultation visit. Subsequent services are charged up to 7 days before the service start date. Late payments are subject to a $25 fee if not settled within 48 hours. Cancellations for vacation pet care: Within 4 weeks of overnight bookings or 2 weeks of day visits are subject to a 50% cancellation fee. Cancellations for dog walking: Full price charged if not canceled within 24 hours. More than 24 hours, you are credited to the next week.

21. Photographs.

Client grants Peppy’s permission to take and use photographs of their pets for social media, website, and other marketing materials.

22. Force Majeure.

Peppy’s shall not be liable for any failure to perform its obligations under this agreement due to circumstances beyond its control, including but not limited to acts of God, natural disasters, war, strikes, pandemics, government orders, or any other event that makes the provision of services impossible or impractical. In such cases, Peppy’s will make reasonable efforts to notify the Client and resume services as soon as feasible.

23. Indemnification.

Client agrees to indemnify and hold harmless Peppy’s, its agents, affiliates, contractors, and employees from and against any and all claims, demands, damages, costs, expenses (including attorneys’ fees), liabilities, and losses resulting from or arising out of the provision of pet care services, including but not limited to any claims related to the behavior of the Client’s pet(s) or injury or damage caused to third parties by the Client’s pet(s) during the Service Period.

24. Modification of Agreement.

Any changes, amendments, or modifications to this agreement must be made in writing and signed by both the Client and Peppy’s. Verbal agreements or changes made without written confirmation from Peppy’s will not be enforceable.

25. Waiver of Liability for Weather-Related Events.

In cases of severe weather, including but not limited to snowstorms, extreme heat, or dangerous driving conditions, Peppy’s reserves the right to delay or reschedule services for the safety of its employees and pets in care. Peppy’s is not liable for any missed services due to weather-related events.

26. Pet-Specific Medical Disclosure.

Client agrees to disclose any and all medical conditions or behavioral issues known to them before the start of any Service Period. Failure to provide accurate information may result in additional costs or termination of services. Peppy’s reserves the right to refuse or discontinue services if a pet’s medical or behavioral condition poses a danger or risk that was not disclosed at the time of signing this agreement.

27. Emergency Evacuation Plan.

In the event of a natural disaster or other emergency requiring evacuation of the Client’s pets, Peppy’s will make reasonable efforts to contact the Client and emergency contacts. If no contact is made, Peppy’s is authorized to remove the pets from the home and ensure their safety at the Client’s expense. Client agrees to cover all costs related to emergency boarding, care, and transportation.

28. Severability and Choice of Law.  

If any part of this agreement is deemed invalid, the remaining terms remain enforceable. This agreement is governed by the laws of the State of Colorado.
